Steel Wire Garment Hangers from People's Republic Of China (A-570-918)

Scope Description:

The merchandise that is subject to the order is steel wire garment hangers, fabricated from carbon steel wire, whether or not galvanized or painted, whether or not coated with latex or epoxy or similar gripping materials, and/or whether or not fashioned with paper covers or capes (with or without printing) and/or nonslip features such as saddles or tubes. These products may also be referred to by a commercial designation, such as shirt, suit, strut, caped, or latex (industrial) hangers. Specifically excluded from the scope of the order are wooden, plastic, and other garment hangers that are not made of steel wire. Also excluded from the scope of the order are chrome-plated steel wire garment hangers with a diameter of 3.4 mm or greater. The products subject to the order are currently classified under U.S. Harmonized Tariff Schedule
(“HTS”) subheadings 7326.20.0020, 7323.99.9060, and 7323.99.9080.

Although the HTS subheadings are provided for convenience and customs purposes, the written description of the merchandise is dispositive.

Requestor: Target Corporation; its chrome-plated accessory hangers are outside the scope of the antidumping duty order; May 12, 2010.

Scope Rulings Completed Between October 1, 2011, and December 31, 2011:
Requestor: M&B Metal Products Inc.; imports of steel wire garment hangers from the Socialist Republic of Vietnam exported by Angang Clothes Rack Manufacture Co., Ltd. and Quyky Yanglei International Co., Ltd. are circumventing the antidumping duty order through means of third country assembly or completion of merchandise imported from the People's Republic of China; October 28, 2011.

Requestor: Robert H. Ham Associates Ltd.; its retail display hangers are not within the scope of the antidumping duty order; December 1, 2011.

Requester: Whitmor Inc.; space-saving lingerie and accessory hangers are outside the scope of the antidumping duty order because they are manufactured and used in manners distinct from subject merchandise. Specifically, these hangers are intended for use in the home and are not sold to dry cleaners, laundries, uniform rental services, or similar industrial operations. Moreover, the Department previously has found that hangers with unique designs similar to Whitmor Hangers renders them distinguishable in use from ``in-scope merchandise'' which is used for industrial laundries, uniform rental companies, dry cleaners, or to be taken away with garments from stores as described in the Petition;\3\ August 20, 2013.

Scope Rulings Made Between April 1, 2014 and June 30, 2014
Requestor: Dollar General Corporation, LLC (``Dollar General''); The Vinyl-Coated Hanger is within the scope of the antidumping duty order (``Order'') because the physical description of this hanger does not meet any of the exclusions in the scope, while the Five-Tier Swing Arm Slack Rack Hanger, Chrome Tie/Belt Hanger, Slacker Hanger, and Four-Tier Skirt/Slack Hanger are outside the scope because they are distinct in production process, as well as form and shape (and use) from hangers covered by the scope of the antidumping duty order as determined by the Department of Commerce; January 16, 2014.

Requestor: Trendsformers, LLC; hanging jewelry organizers (``Hang It Jewelry Organizers'') are outside the scope of the antidumping duty order because they are manufactured and used in manners distinct from subject merchandise.
