Personal Information Received From the EU: McAfee collects and stores personal information about our users, including some or all of the following: name; email address; and billing information, such as address, phone number and credit card information. This information is stored on our servers, which are housed in the United States. We also receive and may store certain types of information whenever you interact with us. For example, like many Web sites, we use "cookies" and we obtain certain types of information when your Web browser accesses www.mcafee.com.
In order to tailor our subsequent communications to our customers and continuously improve our products and services (including registration), we may also ask users to provide us with information regarding personal or professional interests, experience with our products, and more detailed contact preferences. Customers and visitors always have the option of choosing not to provide us with this information.
McAfee Consumer provides notice to customers regarding the collection and use of their personal information through privacy policies posted on consumer sites. As of February 2004, McAfee Consumer has 12 localized privacy policies worldwide, based on one standard policy that is localized for language, local laws and specific local relationships or partnerships. As we roll out sites targeted at different consumer geographies, we concurrently roll out additional privacy policies to meet the requirements of those geographies.
There are multiple links to these sites in all locations. Currently, the policies themselves are posted in a total of 37 locations, and a link to the appropriate policy can be found on every page where a consumer may be asked to provide personal information.
The policies provide notice regarding the following:
What information we collect
How we use the information
With whom we share the information
Our opt-in policy and the choice we provide consumers on the use or collection of their information
How consumers can correct and update the personal information we retain about them
Our policy on deleting or deactivating names from our database, and
Our policy regarding children who visit our site
General Information Collection Principles
We do not collect sensitive information as defined by the EU Directive on Data Protection and the U.S. Department of Commerce Safe Harbor program.
We do not specifically market to children, nor do we intentionally collect information from children.
We only collect information as necessary for the purposes described in our Privacy Policy Statements under Uses of Data.
Any information collected “passively” on a user may only be used for the following purposes as described on our website:
by McAfee Consumer to improve the individual user experience, improve the functionality of products and services; or
aggregated and used by McAfee Consumer or by third parties for general market analysis on our behalf. Note that in this case the information would no longer be considered “personal information” because it would not be linked to the individual.
The Choice We Provide
For the purpose of choice, we have three basic categories of “use” of the information for which customers are offered different types of choice.
1. Use of information for provision, delivery and/or to ensure proper functionality of service. This includes registration of product, completion of transaction, provision of necessary updates, and provision of notification when service is terminating or may be interrupted for some reason. This use may be accomplished by McAfee Consumer directly, or by partners with whom McAfee works to provide these services.
Users are notified in the privacy policy and at the time of registration that there is no “opt-in” or “opt-out” associated with the use of information for provision of service. In other words, customers may not choose not to have their personal information used in this way, because doing so would limit the effectiveness of the products or services.
2. Use of information by McAfee Consumer to contact users with security information unrelated to provision of service. This might include information about new outbreaks or threats and information about new and additional products and services to help users respond to these threats.
Users are offered the choice, usually in the form of a check-box, to “subscribe” or “unsubscribe” to this type of alert. In addition, on every alert or communication sent, users are offered an easy way to “unsubscribe” to this type of contact. Users may also change this preference at any time by accessing their account information as indicated in our Privacy Policy Statements.
3. Third party use of data. Our third party partners are prohibited from contacting our customers with communications not related to the provision of our services. According to our Privacy Policy Statements, we do not provide information to third parties except to perform services on our behalf which are disclosed in our Uses of Data. Users are not able to “opt-in” or “opt-out” of information sharing with partners when it is done for the purpose of provision of product or service (eg. credit card transaction processing.)
In cases where we transfer personal information to third party partners for the purpose of providing services on our behalf, all third party partner contracts will contain language explicitly requiring compliance to the Safe Harbor principles as a condition of continuing business.
In some of our third party relationship the third party is the “data controller” (for example in some service provider OEM relationships), and we do not have access to or ownership of the personal information of a consumer. In that case, the privacy policy of the third party partner applies, but we encourage appropriate data protection precautions on the part of the third parties.
Sensitive Information Principle
We do not collect or share any sensitive information on our consumers. Sensitive information is defined as personal information specifying medical or health conditions; racial or ethnic origins; political opinions; religious or philosophical beliefs; trade union memberships; or information related to the sex life or sexual preference of an individual.
Onward Transfer of Personal Information
Where McAfee Consumer is the Data Controller, and a third party may be acting as a Data Processor partner, the third party is prohibited from using our customer information for purposes other than the services it has contracted with McAfee Consumer to perform. We also contractually require that third party partners fall into one of the following two categories:
Parties that are subject to regulatory data protection regimes offering the same or greater privacy protection as the Safe Harbor principles applied here; or
Parties whom have certified to McAfee Consumer that they will provide the same or greater privacy protection as the Safe Harbor principles applied here.
